Overview of how data privacy regulations affect your website and why you may need to comply
Many data protection regulations now require website owners to limit or completely avoid tracking users without explicit consent or to have the option to opt-out from tracking.
What is explicit consent?
Explicit consent is a clear, informed, and voluntary agreement given by an individual for the processing of their personal data. It is a higher standard of consent where the individual is fully aware of what their data will be used for, and the consent is actively provided, typically through a clear, affirmative action, such as clicking a button. Explicit consent ensures that the individual is fully informed about the nature, purpose, and scope of data processing and can withdraw their consent at any time. This is required under regulations like the General Data Protection Regulation (GDPR) in certain contexts, particularly when processing sensitive personal data.
In practice, the website owner uses services on their website like Google Analytics, Hotjar, or Microsoft Clarity to keep track of the website visitors. These services track and may even use and share the personal information of the website visitors. To help with data privacy compliance, Clym, as a Consent Management Platform, can be added to the website and can limit or completely avoid tracking users based on what regulations apply and what consent choices the user has made.
Cookies are pieces of information that are stored in the user’s browser. These can be created for multiple purposes and serve as a tool for identifying users; therefore, it can be used to track user behaviour.
As cookies are only manageable by the services, Clym can not manage cookies directly created by services. Therefore, to take control of the tracking happening on the website, Clym needs to manage the services on the website to limit tracking.
