Maryland introduced a comprehensive data privacy law known as the Maryland Online Data Privacy Act (MODPA), most provisions of which will become effective in October, 2025.

What is the Maryland Online Data Privacy Act?
The Maryland Online Data Privacy Act (MODPA) is a comprehensive data privacy law, also known as House Bill 541. It enhances protections for consumer data, providing individuals with rights such as access, correction, deletion, and opting out of targeted advertising, profiling, and data sales. This law aligns with other state privacy frameworks, such as those in California and Virginia, while introducing stricter measures, including data minimization, requiring businesses to collect only necessary data, and opt-in consent for the processing of sensitive data. This aims to improve transparency and accountability for businesses handling personal data.
How will it affect your Clym Widget?
If your Company profile matches the applicability thresholds set by the MODPA, the Widget will be updated to include certain options for visitors entering your website(s). The following rights will be available in the Widget and Compliance Center:
- Request access to the information.
- Request correction and deletion of personal information.
- Request a copy.
- Opt out of profiling and targeted advertising.
- Do not sell my personal information.
Businesses are required to respond to consumer requests within 45 days, with an optional extension of an additional 45 days. While cookie consent is not mandatory, companies must comply with universal opt-out mechanisms (UOOM); therefore, Global Privacy Control (GPC) tracking will be activated by default.
