The Utah Consumer Privacy Act, also known as a UCPA, passed to give Utah state residents more control over their personal data will become effective on December 31st, 2023.
What is UCPA?
The Utah Consumer Privacy Act is the fourth legislature regarding data privacy in the US, addressing the rights of consumers and the obligations of data controllers and processors with regard to the personal information collected. The text of the law was signed into law on March 24, 2022, and is set to go into effect on December 31st, 2023.

How will it affect the widget?
The privacy widget on your website will be updated to include the following rights for users from Utah:
- Right to access: Users will have the ability to confirm whether their personal data is being processed and access it.
- Right to delete: Users can request the deletion of their personal data that they provided to you.
- Right to data portability: Users can obtain a copy of their personal data in a portable and usable format and transmit it to another controller without any hindrance.
- Right to opt-out: Users can opt out of the processing of their personal data for targeted advertising or sale purposes.
Similar to other privacy laws previously enacted by some of the states, such as California, Virginia, and Colorado, consumers should be replied to within 45 days, with a possibility to prolong this term for another 45 days under exceptional circumstances.
Does UCPA require websites to collect consent for cookie placement?
No, consent for processing won't be required. However, the privacy widget will remain visible to users, providing transparency in data processing and easy access to request submission.
Additionally, the Utah Consumer Privacy Act requires controllers to provide consumers with a privacy notice. We recommend that you review the requirements and update your notice.
